Terms of Service

These terms govern the use of Bellhand: the console at app.bellhand.com, the phone agent, and the related services (together, the “Service”). By creating an account or using the Service, you agree to these terms for yourself and for the business you represent (“you”).
1. The Service
Bellhand is software for service businesses. It includes a phone agent that answers calls for your business, books jobs and takes messages, and a console for clients, requests, quotes, jobs, schedules, invoices and payments. The Service changes over time. Some features need setup before they work, such as a phone number, connected accounts or carrier registration, and some features described on our website may not be available yet.
2. Accounts
- Give accurate information and keep sign-in details confidential.
- You are responsible for the people you invite to your account and for what they do in it.
- Tell us at support@bellhand.com right away if you believe someone used your account without permission.
3. The phone agent and your responsibilities
- The phone agent is automated software. It works from the services, prices, hours and other settings you give it, and it can make mistakes. You are responsible for that information and for reviewing bookings, quotes and other results.
- You are responsible for following the laws that apply to your calls, messages and records, including rules on consent, disclosure and do-not-call requests, such as the Telephone Consumer Protection Act and state laws.
- You choose in your settings whether the agent tells callers that it is automated on calls they place to you.
- Do not use the Service to contact people without the consent the law requires, to send spam, or for unlawful, deceptive or harassing purposes.
4. Your data
- The information you and your customers put into the Service belongs to you (“your data”). You allow us to host, process and transmit your data only to provide the Service, to keep it secure, and as described in our Privacy Policy.
- You are responsible for having the right to give us your data, including any notices and consents your customers need.
- You can export your data with the export tools in the console.
- Call records are kept for five years by default, as described in the Privacy Policy.
5. Third-party services
The Service works with services we do not control, such as Thumbtack, Stripe, telephone carriers and speech and language-model providers. Your use of them is subject to their own terms. If a third party changes or stops its service, the related features of Bellhand may change or stop. We are not responsible for third-party services.
6. Fees and payment
- Fees are those shown for your plan in the console or agreed with us in writing. Use beyond your plan, such as extra call minutes, is charged at the rate shown for your plan.
- Payments are processed by Stripe. You authorize us to charge your payment method on file for recurring fees.
- If a payment fails, we may try again. If it stays unpaid, we may pause the phone agent or other features until it is paid.
- Fees do not include taxes unless stated otherwise.
7. Acceptable use
You must not:
- use the Service to break the law or to infringe the rights of others;
- upload content you have no right to use;
- try to access data of other businesses or accounts;
- probe, overload or disrupt the Service;
- reverse engineer the Service, except where the law allows it;
- resell the Service without our written permission.
8. Our property
We own the Service, including its software, design and phone agent. While your account is in good standing, we give you a limited, non-exclusive, non-transferable right to use the Service for your business. If you send us feedback, we may use it freely.
9. Suspension and termination
- You can stop using the Service at any time and ask us to close your account.
- We may suspend or end access if you break these terms, do not pay, or if your use creates a legal or security risk. Where reasonable, we will tell you first.
- After an account is closed, we handle its data as described in the Privacy Policy.
10. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service or the phone agent will be uninterrupted or error-free, or that it will bring any particular number of calls, bookings or jobs.
11. Limitation of liability
To the extent the law allows, Bellhand is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.
12. Indemnity
You will defend and indemnify Bellhand against third-party claims that arise from your use of the Service in breach of these terms or of the law, including claims about calls or messages made for your business.
13. Changes to these terms
We may update these terms. We will post the new version on this page with a new date. When a change is material, account owners will be asked to accept the new version in the console. Using the Service after that means you accept the updated terms.
